Privacy Policy

Effective date: October 15, 2026 · Applies to gessmo.com and our services in the United States and Canada

The short version

  • We collect what you choose to send us, mainly through our project brief, and use it to reply and do the work you ask for.
  • We don't sell your personal information or share it for targeted advertising. We don't run ad pixels or analytics trackers on this site.
  • A few service providers help us (form delivery, email, hosting, fonts). They may process data in the United States.
  • You can ask to see, correct or delete your information at any time: contact@gessmo.com.

1. Who we are

Gessmo LLC ("Gessmo", "we", "us") is a video-advertising studio organized in Wyoming, USA. We make motion ads, AI UGC ads and social content for businesses. This policy explains how we handle personal information collected through gessmo.com and in the course of our work with clients and prospective clients.

Our services are for businesses. When you contact us, you're usually doing so on behalf of a company.

2. What we collect

Information you give us

  • Project brief (gessmo.com/brief): your name, work email, company, website, role, and the details you share about your product, audience, competitors, current ads, claims and proof, budget, timeline, social handles and links to your files.
  • Emails and messages you send us, and anything attached to them.
  • Project materials, if you hire us: logos, fonts, product photos, screen recordings, approvals and feedback. These may include personal information, such as people who appear in your photos or videos.
  • Business and billing details, if you hire us, needed for contracts and invoices. We don't receive or store full payment card numbers on this website.

Information collected automatically

  • Technical data such as IP address, browser type, device type and the pages requested. Our website host and service providers may record these in server logs for security, spam prevention and to deliver the site.
  • Form protection: our form provider may use your IP address and similar data to filter spam.

We don't collect sensitive information such as government ID numbers, health information or precise location through this site. Please don't include it in your brief.

3. How we use it

  • To read your brief, reply to you and prepare a proposal and quote.
  • To deliver the work you hire us for: research, scripts, style boards, ads, revisions and delivery files.
  • To manage our business relationship: contracts, invoices, records and support.
  • To keep the site and our systems secure and to prevent spam and abuse.
  • To meet legal, tax and accounting obligations and to protect our rights.

We use your information only for the purposes above, or for a new purpose with your consent or where the law allows it. We don't use the personal information in your brief or project materials to train AI models of our own. Production tools have their own terms; where a tool lets us keep your materials out of model training, we choose that setting.

4. Who we share it with

We share personal information only with service providers that help us run our business, under terms that limit their use of it to providing their service to us:

Provider typeWhat they do for us
Form delivery (Formspree)Receives brief submissions and delivers them to our inbox; filters spam.
Email (such as Zoho Mail and Google)Sends, receives and stores our email.
Website hosting (systeme.io)Hosts and serves gessmo.com.
Web fonts (Google Fonts)Delivers the typefaces on our pages; your browser requests them from Google, which receives your IP address.
Production tools, if you hire usDesign, video, voice and AI generation tools we use to make your ads, used only with the materials needed for your project and as agreed with you.
Professional advisersLawyers and accountants, under a duty of confidentiality.

We may also disclose information if required by law, to protect our rights or someone's safety, or as part of a business transfer (such as a merger or sale), in which case this policy continues to apply to it.

We only show client work publicly with the client's written permission.

5. Cookies, local storage and tracking

  • No advertising cookies, no analytics trackers, no ad pixels on gessmo.com.
  • Local storage on your device: the brief form keeps a draft of your answers in your own browser so you don't lose them. It isn't sent to us until you press send, and it's cleared after a successful send. You can clear it any time by clearing your browser's site data.
  • Strictly necessary cookies: our website host may set cookies needed to deliver and secure the site.
  • Do Not Track and Global Privacy Control: because we don't track you across websites or sell or share your information for targeted advertising, there is nothing for these signals to switch off on our side. If we ever add such tools, we will honor Global Privacy Control signals as opt-out requests where the law requires and update this policy first.

6. No selling, no targeted ads

We do not sell personal information, and we do not share it for cross-context behavioral (targeted) advertising, as those terms are defined under US state privacy laws. We have not done so in the past 12 months. We don't disclose personal information to third parties for their own direct-marketing purposes.

7. How long we keep it

  • Briefs that don't become a project: deleted within 24 months of our last contact with you, or sooner if you ask.
  • Client records: kept for the length of the work and afterwards as long as needed for legal, tax and accounting obligations (usually up to 7 years for financial records).
  • Project materials: kept for the project and a reasonable period after delivery for revisions, then deleted or returned, unless our agreement says otherwise.

8. How we protect it

We use reasonable administrative, technical and physical safeguards for the sensitivity of the information, including encrypted connections (HTTPS), access limited to people who need it, and providers with recognized security practices. No method of transmission or storage is 100% secure. If a breach affecting your personal information creates a real risk of harm, we will notify you and the authorities as the law requires.

9. Where it's stored

Gessmo is based in the United States, and our service providers may store and process information in the United States and other countries. If you are in Canada, your information may be accessed by courts, law enforcement or national security authorities of those countries under their laws. Before transferring information outside Quebec, we assess whether it will be adequately protected, as Quebec law requires.

10. Your choices and rights

Wherever you live, you can ask us to:

  • tell you what personal information we hold about you and how we use it, and give you a copy;
  • correct information that is wrong or incomplete;
  • delete your information (unless we must keep it for legal reasons, which we'll explain);
  • stop contacting you;
  • withdraw a consent you gave, subject to legal or contractual limits.

How to make a request: email contact@gessmo.com with the subject "Privacy request". We'll confirm we received it, may ask for information to verify your identity (such as replying from the email address you used with us), and will respond within 30 days, or within the time the law in your location allows. If you use an authorized agent, we may ask for proof of their authority. There's no charge, and we will never treat you differently for exercising your rights.

11. US state notices

California. Under the California Online Privacy Protection Act, this policy describes the categories of personal information we collect through our site (identifiers and contact details, business and professional information, the content of your messages and briefs, and technical data), the types of third parties we share it with (section 4), how you can review and request changes (section 10), and how we'll tell you about changes (section 15). Under California's "Shine the Light" law, we don't share personal information with third parties for their direct-marketing purposes. If the California Consumer Privacy Act applies to us now or in the future, California residents have the rights to know, delete, correct and opt out of sale or sharing, and to limit use of sensitive personal information; we don't sell, share or use sensitive personal information for those purposes, and requests can be made as described in section 10.

Other states. Residents of states with consumer privacy laws (such as Virginia, Colorado, Connecticut, Texas, Oregon and others) may have similar rights to access, correct, delete and obtain a copy of their personal information, and to opt out of sale, targeted advertising and profiling. We honor these requests through section 10. If we decline a request, you may appeal by replying to our decision with the subject "Privacy appeal"; we'll respond within the time the law requires and, if we deny the appeal, explain how to contact your state attorney general.

12. Canada and Quebec

We handle personal information of people in Canada in line with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for people in Quebec, the Act respecting the protection of personal information in the private sector (as amended by Law 25). In particular:

  • We collect only what we need for the purposes in section 3, and we ask for your consent when you send us a brief (express consent for the brief form, which you can withdraw at any time).
  • Our Privacy Officer is accountable for our compliance (section 16).
  • You can access and correct your information as described in section 10.
  • We don't use automated decision-making to make decisions about you based on your personal information.

If you're not satisfied with our answer, you can contact the Office of the Privacy Commissioner of Canada (priv.gc.ca) or, in Quebec, the Commission d'accès à l'information (cai.gouv.qc.ca).

13. Emails from us

We email you to answer your request and to run a project you've hired us for. We don't add you to a newsletter or send marketing emails without your consent, and any marketing email we send will identify us, include our contact details and offer a simple way to unsubscribe, as required by the US CAN-SPAM Act and Canada's Anti-Spam Legislation (CASL).

14. Children

Our site and services are for businesses and are not directed to children. We don't knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we'll delete it.

15. Changes to this policy

We may update this policy as our services or the law change. We'll post the new version here with a new effective date, and if a change is significant we'll make it clear on this page or tell clients directly before it applies.
